Supplier Code of Conduct
This Supplier Code of Conduct (the “Code”) establishes the standards to ensure that Gift Shopie’s suppliers and supply chains are safe, that workers within those supply chains are treated with respect and dignity, and that business operations surrounding those supply chains are conducted in an environmentally responsible and ethical manner. At Gift Shopie, we believe that the process of making and delivering products is just as important as their quality. We are committed to ensuring that the production of our products aligns with the Labor Standards set forth by the International Labour Organization.
This Code outlines the minimum standards we require from those supplying products and services to Gift Shopie or under our brand name (each, a “Supplier”). We expect all Suppliers, and those under their control and direction, to adhere to this Code and conduct their operations in an ethical manner, treating workers as valuable assets and demonstrating responsible environmental stewardship. Failure to meet these standards not only violates our expectations but also poses a significant risk to the reputation we work hard to maintain with our customers and partners.
By engaging in business with Gift Shopie, each Supplier agrees to comply with this Code and to ensure that all agents and others acting under their control also comply with this Code. Any reference to a “Code of Conduct,” “Supplier Code of Conduct,” or similar terms in purchase orders, intellectual property licenses, or other contracts with Gift Shopie refers to this Code, which we may revise at our sole discretion from time to time. We reserve the right to change this Code at any time, with or without notice, effective immediately upon posting on our website. Continued business with Gift Shopie following the posting of changes to this Code constitutes Supplier’s acceptance of such changes. We strongly encourage all Suppliers to review this Code periodically.
1. We Treat Our Workforce with Dignity
Gift Shopie expects Suppliers to recognize the human rights of workers and to treat them with dignity and respect. This applies to all workers, including temporary, migrant, student, intern, apprentice, contract, and permanent employees.
A. Freely Chosen Employment
Suppliers must:
- Prohibit forced, bonded, or indentured labor, involuntary or exploitative prison labor, slavery, and human trafficking.
- Not place unreasonable restrictions on workers’ freedom of movement within Supplier facilities.
- Provide workers with a written employment agreement in a language they understand before they leave their country of origin.
- Not require involuntary work or prevent workers from leaving their jobs freely.
- Not retain or destroy workers’ identity or immigration documents.
- Not charge workers recruitment fees or related costs; any such fees found to have been paid by workers must be reimbursed by the Supplier.
B. Young Workers
Suppliers must:
- Not employ child labor at any stage of supplying products or services to Gift Shopie. “Child” refers to anyone under the age of 15, or under the legal working age in the applicable jurisdiction, whichever is greater.
- Protect workers under the age of 18 from hazardous work, night shifts, and overtime.
- Properly manage student workers, ensuring they receive adequate support and training, and are compensated fairly.
C. Working Hours
Suppliers must:
- Comply with all applicable laws regarding working hours, ensuring that workers are not required to work beyond the maximum hours set by law.
- Not require involuntary overtime or punish workers for refusing overtime.
D. Wages and Benefits
Suppliers must:
- Comply with all wage and hour laws, ensuring that workers receive timely and accurate compensation, including for overtime work.
- Not make deductions from wages as a disciplinary measure.
- Provide workers with clear, timely wage statements.
E. Humane Treatment
Suppliers must:
- Prohibit any form of harsh or inhumane treatment, including sexual harassment, abuse, corporal punishment, and verbal abuse.
- Clearly define and communicate disciplinary policies to workers.
- Not require workers to live in dormitories or company-owned housing or restrict their movements outside of working hours.
F. Non-Discrimination
Suppliers must:
- Provide a workplace free of harassment and discrimination.
- Not discriminate based on race, color, age, gender, sexual orientation, gender identity, ethnicity, disability, pregnancy, religion, or any other protected characteristic.
- Provide reasonable accommodations for religious practices.
- Ensure that migrant workers receive the same rights and compensation as local workers.
G. Freedom of Association
Suppliers must:
- Respect the rights of workers to form and join trade unions, to bargain collectively, and to engage in peaceful assembly.
- Ensure that workers and their representatives can communicate openly with management without fear of retaliation.
H. Subcontracting and Homeworking
Suppliers must:
- Not subcontract without the prior express written consent of Gift Shopie.
- Ensure that homeworking complies with all applicable laws and this Code, including verification of workers’ age, tracking of hours and wages, and proper compensation.
I. Location Specificity
This Code applies separately to each of the Supplier’s facilities. Approval of one facility does not extend to others.
2. We Believe in a Healthy and Safe Workplace
Gift Shopie requires Suppliers to ensure that their work environments are safe and conducive to worker health. This enhances product quality, consistency, and worker morale.
A. Occupational Safety
Suppliers must:
- Identify, assess, and mitigate safety hazards through design, engineering, and administrative controls.
- Provide workers with appropriate personal protective equipment and training on workplace hazards.
B. Emergency Preparedness
Suppliers must:
- Implement and maintain emergency plans and response procedures, including worker training, drills, and clear evacuation routes.
C. Occupational Injury and Illness
Suppliers must:
- Implement systems to prevent, manage, and report occupational injuries and illnesses, including providing appropriate medical care and investigating causes to prevent recurrence.
D. Industrial Hygiene
Suppliers must:
- Manage exposure to chemical, biological, and physical agents through proper controls and protective programs.
E. Physically Demanding Work
Suppliers must:
- Mitigate risks associated with physically demanding tasks, such as manual material handling and repetitive lifting.
F. Machine Safeguarding
Suppliers must:
- Ensure machinery is equipped with safety guards and regularly maintained to protect workers.
G. Sanitation, Food, and Housing
Suppliers must:
- Provide workers with access to clean toilet facilities, potable water, and sanitary food preparation areas.
H. Health & Safety Communication
Suppliers must:
- Provide ongoing health and safety training and clearly post safety information in a language workers understand.
3. We Care About the Environment
Gift Shopie expects Suppliers to minimize their environmental impact and uphold responsible environmental practices.
A. Environmental Permits and Reporting
Suppliers must:
- Obtain and maintain all required environmental permits and comply with all related regulations.
B. Pollution Prevention and Resource Reduction
Suppliers must:
- Minimize waste and emissions by implementing effective pollution controls and resource conservation practices.
C. Hazardous Substances
Suppliers must:
- Manage hazardous substances safely, ensuring they are properly labeled, stored, and disposed of.
D. Non-Hazardous Solid Waste
Suppliers must:
- Implement systems for responsible waste management, including reduction, recycling, and disposal.
E. Air Emissions
Suppliers must:
- Monitor and control air emissions in compliance with applicable regulations.
F. Water Management
Suppliers must:
- Implement water management programs to monitor and minimize water use and contamination.
G. Energy Consumption and Greenhouse Gas Emissions
Suppliers must:
- Track energy consumption and greenhouse gas emissions and implement strategies to improve energy efficiency.
4. We Ascribe to a High Ethical Standard
Gift Shopie expects Suppliers to conduct business with integrity, honesty, and transparency.
A. Business Integrity
Suppliers must:
- Uphold the highest standards of integrity and enforce a zero-tolerance policy for bribery, corruption, and embezzlement.
- Comply with all applicable anti-bribery and anti-corruption laws.
B. No Improper Advantage
Suppliers must:
- Not engage in any form of bribery or corruption and must implement procedures to ensure compliance with anti-corruption laws.
C. Disclosure of Information
Suppliers must:
- Transparently document and report all business dealings and disclose information as required by law.
D. Intellectual Property
Suppliers must:
- Respect intellectual property rights and protect Gift Shopie’s confidential information.
E. Fair Business Practices
Suppliers must:
- Conduct business in a manner that reflects positively on Gift Shopie’s reputation and not engage in deceptive or unethical practices.
F. Protection of Identity and Non-Retaliation
Suppliers must:
- Implement programs to protect whistleblowers and ensure that workers can report concerns without fear of retaliation.
G. Responsible Sourcing of Minerals
Suppliers must:
- Implement policies to ensure that minerals used in products do not finance human rights abuses and must conduct due diligence on the source of these minerals.
H. Privacy
Suppliers must:
- Protect the privacy of personal information and comply with applicable privacy laws.
5. We Are Committed to Making a Difference
Gift Shopie requires Suppliers to implement effective management systems to ensure compliance with this Code and continuous improvement in their operations.
A. Supplier Commitment
Suppliers must:
- Establish policies affirming their commitment to social and environmental responsibility, endorsed by senior management and communicated to workers.
B. Management Accountability and Responsibility
Suppliers must:
- Clearly identify senior management responsible for implementing and enforcing the management system.
C. Legal and Customer Requirements
Suppliers must:
- Continuously monitor and comply with all applicable laws and customer requirements, including those in this Code.
D. Risk Assessment and Management
Suppliers must:
- Implement processes to identify, assess, and mitigate risks related to legal compliance, environmental impact, health and safety, and labor practices.
E. Improvement Objectives
Suppliers must:
- Set and regularly review objectives for improving social and environmental performance.
F. Training
Suppliers must:
- Provide training to workers to ensure they understand and can meet the standards set forth in this Code.
G. Communication
Suppliers must:
- Communicate policies, practices, and performance expectations clearly and accurately to workers, sub-suppliers, and customers.
H. Worker Feedback, Participation, and Grievance
Suppliers must:
- Implement processes to gather feedback from workers and address grievances related to violations of this Code.
I. Audits, Assessments, and Corrections
Suppliers must:
- Conduct regular self-audits and implement corrective actions to ensure ongoing compliance with this Code.
J. Documentation and Records
Suppliers must:
- Maintain accurate records to demonstrate compliance with this Code and applicable laws.
6. We Operate with Transparency and Flexibility
During and up to three years after the relationship between Gift Shopie and a Supplier, the Supplier must:
- Maintain complete and accurate records related to compliance with this Code.
- Allow Gift Shopie to audit these records and inspect facilities to verify compliance, including unannounced audits and private worker interviews.
- Promptly inform Gift Shopie if unable to meet any standards in this Code and seek written approval for any deviations.
